Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Thrice M Financial Consulting, LLC ("Company," "we," "our," or "us"), a limited liability company organized in Minnesota, governing your access to and use of the Kyndo mobile application and website (collectively, the "Service").

01 Acceptance of Terms

By downloading, installing, or using Kyndo, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms apply to all users of the Service, including free and paid tier users.

02 Eligibility

To use Kyndo, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Be a resident of the United States
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable law

By using Kyndo, you represent and warrant that you meet all eligibility requirements. If you are using Kyndo on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

03 Your Account

Registration

You must create an account to access most features of Kyndo. You agree to provide accurate, complete, and current information during registration and to keep it updated.

Account security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You agree to:

• Use a strong, unique password for your Kyndo account
• Notify us immediately at info@thricemfinancial.com if you suspect unauthorized access
• Not share your credentials with any other person
• Sign out of your account after each session on shared devices

We are not liable for any loss or damage arising from your failure to protect your account credentials.

One account per user

Each person may maintain only one Kyndo account. Creating multiple accounts to circumvent restrictions or abuse the Service is prohibited.

04 The Service

Kyndo provides personal finance management tools designed for individuals with variable, freelance, or blended income, including:

• Income Mode Tracking — Lean, Normal, and Surge modes based on your income baseline
• 90-Day Cash Flow Forecast — projected balance trends based on your entered data
• Budget Management — expense tracking and category-level spending analysis
• Debt Elimination Planning — avalanche and snowball debt payoff strategies
• Net Worth Tracking — asset and liability management with historical trends
• AI Financial Coaching (Vee) — conversational guidance powered by Claude AI
• Tax Reserve Calculator — self-employment tax estimation tools
• Daily Money Check-in — financial wellness mood tracking
• Invoice Tracking — pending income management for freelancers

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

05 Not Financial Advice

All content, calculations, forecasts, and AI coaching responses provided by Kyndo — including Vee's responses — are for informational and educational purposes only. They are based solely on the data you enter and should not be relied upon as a substitute for professional advice.

We strongly encourage you to consult qualified financial, tax, and legal professionals before making significant financial decisions. Kyndo's forecasts and recommendations are estimates and projections, not guarantees of future results.

The Company is not a registered investment advisor, broker-dealer, or financial planner. No fiduciary duty is created by your use of the Service.

06 Acceptable Use

You agree to use Kyndo only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service for any illegal purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of the Service, other accounts, or our infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app
• Scrape, crawl, or use automated means to access the Service without our written permission
• Introduce viruses, malware, or other harmful code into the Service
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service to store or transmit material that is defamatory, obscene, or otherwise objectionable
• Use the AI coaching features to generate content that violates applicable laws or third-party rights

We reserve the right to terminate or suspend your account for violations of these use restrictions without prior notice.

07 Intellectual Property

Our property

The Kyndo name, logo, app design, source code, features, and content (excluding your personal data) are owned by Thrice M Financial Consulting, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

Your data

You retain full ownership of all financial data, goals, and content you enter into Kyndo. By using the Service, you grant us a limited, non-exclusive license to store and process your data solely to operate and improve the Service as described in our Privacy Policy.

Feedback

If you provide us with feedback or suggestions about the Service, you grant us a perpetual, royalty-free right to use that feedback to improve Kyndo without any obligation to you.

08 Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Kyndo, you consent to the collection and use of your information as described in the Privacy Policy.

09 Fees & Payments

Kyndo is currently available as a free download on the Apple App Store. We may introduce paid subscription tiers or premium features in the future. If we do, we will:

• Clearly disclose all fees before you are charged
• Provide advance notice of changes to existing pricing
• Process payments through Apple's App Store billing system

All billing for in-app purchases is handled by Apple. Refund requests for App Store purchases must be made through Apple per their standard refund policy. We do not directly handle payment card data.

10 Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES THAT FORECASTS, CALCULATIONS, OR AI RESPONSES WILL BE ACCURATE OR RELIABLE
• WARRANTIES THAT ANY DEFECTS WILL BE CORRECTED

Financial forecasts and projections provided by Kyndo are estimates based on data you enter. Actual financial outcomes may differ materially from any projections. We make no guarantee of any financial result from using the Service.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THRICE M FINANCIAL CONSULTING, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES ARISING FROM YOUR RELIANCE ON FINANCIAL FORECASTS, AI RESPONSES, OR OTHER CONTENT IN THE SERVICE
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• DAMAGES ARISING FROM ANY INTERRUPTION OR CESSATION OF THE SERVICE

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed $100 USD or the amount you paid us in the 12 months preceding the claim, whichever is greater.

Some jurisdictions do not allow limitations on certain damages, so some of the above may not apply to you.

12 Indemnification

You agree to defend, indemnify, and hold harmless Thrice M Financial Consulting, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, costs, and expenses (including attorneys' fees) arising from:

• Your use of the Service in violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights
• Any content you submit or transmit through the Service

13 Termination

By you

You may stop using the Service at any time. To delete your account and associated data, email info@thricemfinancial.com with a deletion request.

By us

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for:

• Violation of these Terms
• Conduct we believe is harmful to other users or our business
• Extended inactivity
• Discontinuation of the Service

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will do so, including Sections 7, 10, 11, 12, and 14.

14 Governing Law & Disputes

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at info@thricemfinancial.com. If informal resolution fails, disputes shall be resolved in the state or federal courts located in Hennepin County, Minnesota, and you consent to personal jurisdiction in those courts.

You agree that any claim must be brought individually and not as part of a class action or consolidated proceeding, to the fullest extent permitted by law.

15 Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you via push notification or in-app message for significant changes

Your continued use of the Service after the updated Terms are posted constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the Service.
